PURPOSE
This text presents to users and customers the conditions of use and registration that are applicable to https://www.marbellabanussuites.com/, and it contains all the rights and obligations of the parties.
All users who visit or access our platform and / or who use any of the services that we offer, accept the conditions of use and the privacy policy, as well as the different modifications and / or additional legal texts that are included in the future. If you do not agree with any of the conditions, you can unsubscribe from the service at any time or if you are not a registered user, you may exit the platform.

Together with these conditions, each of the services provided may be regulated by specific conditions of use and registration, and it is mandatory in any case for the user to expressly accept these conditions before their use and / or contracting.

ELECTRONIC CONTRACTING OF SERVICES

In accordance with the provisions of article 23 and those that follow it of Act 34/2002 on information society services and electronic commerce, contracts entered into electronically will produce all the effects provided for by the legal system, as long as both parties agree and this can be accredited.
For these purposes, it will be understood that the monitoring of all the phases of the reservation process and, where appropriate, the payment of the amount due, necessarily implies the provision of the express consent required for contracting the service.
In the same way, and in accordance with the provisions of article 27 of Act 34/2002 on services of the information society and electronic commerce, all the information related to it is available to the users before the start of the contracting process.
The contracting conditions stated below are directly applicable to reservations and stays made available through the web site https://www.marbellabanussuites.com/, unless expressly provided otherwise.

RESERVATION AND CONTRACTING PROCEDURE

The reservation procedure is carried out completely electronically through our platform, without there ever being a physical presence of the parties and / or external physical transaction.
Anyone with Internet access can carry out the contract as long as they are over 18 years of age
The phases of the contracting procedure are visible to users throughout the entire contracting procedure. 3 phases can be identified:

• User identification.
• Selection of the reservation and payment method.
• Reservation confirmation

The user only has to select the accommodation and the dates on which they wish to make a reservation and press the confirmation button provided for this purpose. In this way, the contracting procedure will begin, which will always follow the steps described above for all available services.

Once the establishment has been selected, as well as the number of nights, the applicable taxes, the total price and the method of payment, the platform will show the user a summary of the order, together with the applicable contracting conditions, which in any case must be expressly accepted by the user in order to continue with the contracting process.

Once the acceptance checkbox for the contracting conditions has been marked, in case of having selected any of the electronic means as payment method, the user will be redirected to the external payment platform to make the payment, where https://www.marbellabanussuites.com/have no possibility of accessing the user’s credit card data and / or payment systems at any time. The security of the payment procedure is guaranteed by the financial institution.

Once the service has been hired, the website will display a summary of the purchased services.
If credit card has been selected as the payment method, it will be carried out through the bank’s POS, a platform completely unrelated to and independent from the vendor.
Within a maximum period of 24 hours, the contractor of the service will receive an email with all the information regarding their reservation . This document is the confirmation that the hiring has been carried out successfully, and it is valid as a means of accreditation for any type of claim, as long as proof of the corresponding payment is attached.

In the confirmation email you will find the exact address of the apartment, contact details, and the rest of the instructions for arrival and departure.
The provider informs the user that all the contracts fwill be registered in a file for the control and management of reservations and contracts, and it will contain the information of the reservation, additional information to guarantee security and evidence of the correct performance of the procedure.

https://www.marbellabanussuites.com/ is not responsible in case of specific failures in the continuity of the service or, where appropriate, for the lack of timely availability of the service.

In the event that, for reasons beyond our control, the reservations or accommodations are not available after the contract is entered into, from the moment of notification of the incident, the user is empowered to request the provider to terminate this contract and return the amount paid for the services that were not used, which will be duly reimbursed through the same method selected for the initial payment or, where appropriate, by bank transfer.
In the event that any of the content accessible through the platform were contrary to current regulations, we will proceed with its immediate withdrawal, as soon as we acknowledge the situation and corroborate the facts.

CANCELLATION POLICY
Strict
A full refund is only possible if the arrival date is at least 30 days away and the cancellation occurs within 48 hours from the time of booking. 50% will be refunded when the cancellation is made at least 29 to 14 days prior to arrival and the cancellation is made within 48 hours from the time of booking. Cancellations made during the days prior to arrival (less than 14 days) are non-refundable.

RESERVATION OF THE APARTMENT
The entire stay shall be paid in full at the time of booking.
BAIL

The guest assumes full responsibility for any damage that may be caused to the rented property and its contents.
The amount of the deposit of 500€ will be used to cover, in addition to the expenses mentioned in the previous paragraph, the following concepts as compensation(1):

• Littering: 25€
• Living dirty plates, cups or cutlery: 25€
• Losing the key: 75€
• Smoking inside the building: 70€
• Entry of more people than indicated in the reservation: 100€ per person and day.
• Throwing parties or doing annoying activitites(2) in the apartment: 100€
• Leaving after the established check-out time if it doesn’t prevent the next guest from using the service: 50€ per each hour or fraction (except with written authorization).
• Leaving after the established check-out time if it prevents the next guest from using the services: in addition to the above penalty, you will incur expenses for the relocation of the new guest.
• Missing objects: Repurchase cost.
• If the amount of the deposit does not cover the aspects mentioned in the previous points, the guest is personally responsible for covering the difference.
• If there are more guests who assume responsibility for the deposit, they shall sign on the back of this sheet, and enter the same information required of the main guest, making them jointly responsible for the obligations arising from this document.
• The deposit will be refunded on the day of check-out if paid in cash and within 7 days after check-out if another payment method is used.
• The signing of this document implies satisfaction with the state of conservation and cleanliness of the leased property, as well as the proper functioning of all devices and appliances.

(1) The penalties established may be complemented with the termination of the contract and expulsion from the accommodation, if applicable.(2) Noise above 35dB during the day and 30dB at night.

BEHAVIOR AND RESPONSIBILITIES

Described in Bail and these are the additional rules:
No celebration of any kind of party or event is allowed.
Smoking is strictly prohibited.
Quiet hours: 22:00 to 10:00 AM.
It is not allowed to exceed the maximum number of guests.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

At https://www.marbellabanussuites.com/ we are deeply committed to the protection of intellectual property rights. That is why we have established the following conditions and policies:

1. RELATED TO THE ONLINE PLATFORM
The provider guarantees the user that he is the legitimate owner of the platform and that it is not involved in any type of legal dispute prior to signing this contract.

The user expressly acknowledges that the provider holds all right, title and interest on the platform and the IT developments associated with the service, as well as on all its modules, modifications and updates and on any element and / or functionality that was developed on it, regardless of whether it has been requested by the user or not. For these purposes, it includes without limitation, the recognition of the ownership of the provider of all copyright, intellectual property, and / or industrial rights, and the fact that the provider is able to exploit the platform, without any restriction of a temporary or territorial nature, relative to means of dissemination or modes of exploitation and without limitations other than those established by law.

The structure, characteristics, codes, working methods, information systems and exchange thereof, development tools, know-how, methodologies, processes, technologies or algorithms that constitute and / or may constitute the platform, are the exclusive property of the provider, and they are duly protected by national and international laws of intellectual and / or industrial property, and cannot be subject to further modification, copying, alteration, reproduction, adaptation or translation by the user, without the prior express consent of the vendor.

In the same way, all user manuals, texts, graphic drawings, databases, that complement the platform and / or the materials associated with it, are the property of the provider, and cannot be subjected to further modification, copying, alteration, reproduction, adaptation or translation by the user.

The availability of the platform as a service or the mere access by the user does not imply, in any case, the transfer of ownership, or the granting of a right of use in favor of the user other than that expressed in these conditions.

In order for the user to be able to use the platform, which is the exclusive property of the provider, he grants by virtue of this contract a non-exclusive license of use in favor of the user, for a period of time limited to each connection period, of a spatial scope. unlimited to the extent that it can be accessed from any computer with an Internet connection. The license is non-transferable, revocable and not sublicensable.

In any case, any type of reproduction, imitation, transmission, translation, modification, elaboration of derivative work and / or public communication is absolutely prohibited, regardless of the means used for it, where the offending user assumes all direct or indirect responsibilities that could arise from it.
For any aspect that is not expressly recognized in this contract, it will be understood that all rights are reserved for the provider, and written authorization from the provider is necessary to carry it out.

2. RELATING TO THE CONTENTS AND INFORMATION OF THE USERS

All content and information published or managed by users on the platform are the exclusive property of the user, while https://www.marbellabanussuites.com/ is a mere provider of information society services in charge of data storage.
The provider does not receive any type of intellectual property rights from the fact that the user hosts or manages data on its platform, so in no case may the provider treat them for purposes other than those directly related to the provision of the services hired.

CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of natural persons in terms of the processing of personal data and its free movement, all the personal data submitted during the provision of the services will be treated in accordance with the terms stated in the Privacy Policy, which all users must expressly and previously accept in order to register.
Any user who accepts these conditions of use, accepts in an informed, express and unequivocal way our Privacy Policy, and can exercise their rights of access, rectification, cancellation and opposition regarding their personal data, which they can act upon as reported in the aforementioned Privacy Policy.

TEMPORARY CONDITIONS

These conditions will enter into force on the date of contracting the service

FINANCIAL CONDITIONS

The rates applicable to each of the services offered through the platform will be solely and exclusively those that are published on the online platform, and they are the only valid ones, except for typographical or transcription errors, in which case the provider will work to modify them immediately.

The provider reserves the right to cancel the contracts entered into from the moment they become effective in the event that it detects the existence of typographical or transcription errors in the price and / or taxes applied to the transaction.

The provider reserves the right to make any type of modification on the rates of each accommodation, and commits to publish them on the platform in a visible way for users. Unless otherwise stated, the modification of rates will not be retroactive.

The amounts can only be paid by direct debit or by credit card, and the provider does not have access to any bank or credit card information at any time.

All rates will be increased by the amount corresponding to the taxes in force on the date of issuance of the invoice, and this will be duly reflected in the summary of each purchase.

TERMINATION OF CONTRACT

This contract may be terminated whenever any of the following circumstances occurs:
• Breach of the obligations set forth in this contract.
• For the course of its duration
• In the event that the due amounts are not paid in accordance with the agreed terms and form. The reservation will be automatically blocked the day after the non-payment occurs. For its reactivation it will only be necessary to make the payment of the corresponding amount.
• The dissolution, liquidation or loss of legal personality.
• Any substantial change or variation of the essential conditions that were indicated in this contract to carry out the execution of this contract.

EXTRAJUDICIAL RESOLUTION OF DISPUTES

Similarly, under the terms set forth in article 14 of EU Regulation 524/2013, on consumer dispute resolution, a direct link is provided to the online dispute resolution platform: https: //ec.europa .eu / consumers / odr / main / index.cfm

APPLICABLE LAW AND JURISDICTION

For any controversy or conflict that may arise, derived from these terms or conditions, Spanish Law will apply. The resolution of legal disputes will be submitted to the jurisdiction of the Courts and Tribunals of the user’s or client’s address.

OBJETO

Mediante el presente texto ponemos a disposición de todos los usuarios y clientes las condiciones de uso y registro que son de aplicación a  https://www.marbellabanussuites.com/, quedando reflejados en éste todos los derechos y obligaciones que asisten a las partes.

Todos los usuarios que visitan o acceden a nuestra plataforma y/o que utilizan alguno de los servicios que ponemos a disposición, aceptan las condiciones de uso y la política de privacidad, así como las diferentes modificaciones y/o textos legales adicionales que sean incluidas en el futuro. En caso de no estar de acuerdo con alguna de las condiciones, puedes darte de baja del servicio en cualquier momento o en caso de no ser usuario registrado, abandonar la plataforma.

Junto a las presentes condiciones, cada uno de los servicios prestado puede quedar regulado por condiciones de uso y registro de carácter particular, siendo obligatorio en todo caso que el usuario acepte las mismas expresamente antes de su utilización y/o contratación.

CONTRATACIÓN ELECTRÓNICA DE SERVICIOS

De conformidad con lo dispuesto en el artículo 23 y siguientes de la Ley 34/2002 de servicios de la sociedad de la información y de comercio electrónico, los contratos celebrados por vía electrónica producirán todos los efectos previstos por el ordenamiento jurídico, siempre que concurra el consentimiento de ambas partes y éste pueda ser acreditado.

A estos efectos, se entenderá que el seguimiento de todas las fases del proceso de reserva y en su caso, el abono de la cantidad económica correspondiente, implica necesariamente la prestación del consentimiento expreso requerido para la contratación del servicio.

Del mismo modo, y atendiendo a lo dispuesto en el artículo 27 de la Ley 34/2002 de servicios de la sociedad de la información y de comercio electrónico, se pone a disposición de los usuarios, de forma previa al inicio del procedimiento de contratación toda la información relativa al mismo.

Las condiciones de contratación indicadas a continuación son de aplicación directa a las reservas y estancias puestas a disposición a través del portal web https://www.marbellabanussuites.com/, salvo que expresamente se disponga lo contrario.

PROCEDIMIENTO DE RESERVA Y CONTRATACIÓN

El procedimiento de reserva se lleva a cabo de forma completamente electrónica a través de nuestra plataforma, sin que exista en ningún momento presencia física de las partes y/o transacción física externa.

Cualquier persona con acceso a Internet puede llevar a cabo la contratación siempre y cuando sea mayor de 18 años

Las fases del procedimiento de contratación son visibles para los usuarios a lo largo de todo el procedimiento de contratación. Pueden diferenciarse 3 fases:

• Identificación del usuario.
• Selección de la reserva y forma de pago.
• Confirmación de la reserva

El usuario únicamente debe seleccionar  el alojamiento y las fechas en las que desea reservasr  y pulsar el botón de confirmación de la reserva dispuesto al efecto. De esta forma, dará comienzo el procedimiento de contratación que seguirá siempre los pasos anteriormente indicados para todos los servicios disponibles.

Una vez seleccionado el establecimiento, la cantidad de noches, los impuestos aplicables, el precio total y el medio de pago, la plataforma mostrará al usuario un resumen de la contratación realizada, junto a las condiciones de contratación aplicables, que en todo caso deberán ser expresamente aceptadas por el usuario para poder seguir el proceso de contratación.

Una vez marcada la casilla de aceptación de las condiciones de contratación, en caso de haber seleccionado como forma de pago alguno de los medios electrónicos, el usuario será directamente redireccionado a la plataforma de pago externa correspondiente para realizar el pago, sin que https://www.marbellabanussuites.com/ tenga posibilidad de acceder en ningún momento a los datos de tarjetas de crédito y/o sistemas de pago del usuario.

La seguridad del procedimiento de pago se encuentra garantizada por parte de la entidad financiera.

Una vez finalizada la contratación del servicio, se mostrará una pantalla resumen de la contratación realizada.

En caso de haberse seleccionado el pago mediante tarjeta de crédito, éste se llevará a cabo a través de la TPV del banco, plataforma completamente ajena e independiente del prestador.

En el plazo máximo de 24 horas, el contratante del servicio recibirá un correo electrónico en el que se mostrará toda la información relativa a la reserva contratado. Este documento es la confirmación de que la contratación se ha realizado con éxito, siendo válida como medio de acreditación para cualquier tipo de reclamación, siempre y cuando se adjunte el justificante del pago correspondiente.

En el email de confirmación encontrará la dirección exacta del apartamento, detalles de contacto, y el resto de instrucciones para la llegada y salida.

El prestador informa al usuario de que todas las contrataciones realizadas quedarán registradas en un fichero para el control y gestión de reservas y contrataciones, en el que quedarán reflejados junto a la información de los la reserva contratada, información adicional para garantizar la seguridad y evidencia de la correcta realización del procedimiento.

https://www.marbellabanussuites.com/ no se hace responsable en caso de los fallos puntuales en la continuidad del servicio o en su caso en la falta de disponibilidad puntual del mismo.

En caso de que por motivos ajenos a nuestra voluntad las reservas o alojamientos no se encuentren disponibles tras la contratación desde el momento de la notificación de la incidencia, el usuario queda facultado para solicitar al prestador la rescisión del presente contrato y la devolución de las cantidades económicas correspondientes a los servicios no disfrutados, que serán debidamente reembolsadas a través del mismo medio que hubiera sido realizado el pago inicial o en su caso mediante transferencia bancaria.

En caso de que cualquiera de los contenidos accesibles a través de la plataforma fueran contrarios a la normativa vigente, nos comprometemos a proceder a su retirada inmediata, tan pronto tengamos conocimiento y corroboremos los hechos.

POLÍTICA DE CANCELACIONES

Estricta

Solo es posible el reembolso completo si faltan al menos 30 días para la fecha de llegada y la cancelación se produce durante las 48 horas siguientes a partir del momento de realizar la reserva. Se reembolsará el 50 % cuando la cancelación tenga lugar 29 a 14 días antes de la llegada como mínimo y la cancelación se produce durante las 48 horas siguientes a partir del momento de realizar la reserva. Las cancelaciones que se realicen durante los días previos a la llegada (menos de 14 días) no son reembolsables.

RESERVA DEL APARTAMENTO

Se realiza el pago por la estadía completa al momento de la reserva.

FIANZA

El huésped asume la plena responsabilidad de los desperfectos y daños que pueda hacer al inmueble arrendado así como al contenido del mismo.

El importe de la fianza de 500€ servirá para cubrir, además de los gastos señalados en el apartado anterior, los siguientes conceptos a modo de indemnización:

• Dejar basura en el piso: 25€
• Dejar platos, vasos o cubiertos sucios: 25€
• Pérdida de llaves: 75€
• Fumar en el inmueble: 70€
• Entrada de más personas a las indicadas en la reserva: 100€ persona y día.
• Hacer fiestas o actividades molestas en el inmueble: 100€
• Salida en horario posterior al check-out si no impide el uso al siguiente huésped: 50€ por cada hora o fracción (salvo autorización escrita).
• Salida en horario posterior al check-out si impide el uso al siguiente huésped: además de los anterior, los gastos de realojamiento del siguiente huésped.
• Objetos desaparecidos: Valor de reposición.
• Si el importe de la fianza no cubriera los aspectos señalados en los puntos anteriores el huésped se hace responsable personalmente de sufragar la diferencia.
• En caso de existir más huéspedes que asuman la responsabilidad de la fianza, firmaran al reverso de esta hoja, indicando los mismos datos exigidos al huésped principal, configurándose éstos como responsables solidarios de las obligaciones dimanadas de este documento.
• El importe de la fianza será devuelto el día del check-out si se abona en efectivo y dentro de los 7 días siguientes al mismo si se utilizara otro método.
•           La firma este documento implica la satisfacción con el estado de conservación y limpieza del inmueble arrendado, así como el correcto funcionamiento de todos los aparatos y electrodomésticos.”

Llegada al apartamento: 17:00 a 22:00

Salida del apartamento: hasta 11:00 AM

LIMPIEZA DEL APARTAMENTO

Precio de limpieza del apartamento: 160,00€

COMPORTAMIENTO Y RESPONSABILIDADES

Descriptas en Fianza y estas son las normas adicionales:

No se permite ningún tipo de celebración de fiesta o evento.

Terminantemente prohibido fumar.

Horas de silencio: 22:00 a 10:00 AM.

No se permite superar el máximo de huéspedes establecidos.

DERECHOS DE PROPIEDAD INTELECTUAL E INDUSTRIAL

Desde https://www.marbellabanussuites.com/ estamos profundamente comprometidos con la protección de los derechos de propiedad intelectual. Es por ello que hemos establecido las siguientes condiciones y políticas:

1. RELATIVOS A LA PLATAFORMA ONLINE

El prestador garantiza al usuario que es el legítimo propietario de la plataforma y que ésta no se encuentra inmersa en ningún tipo de disputa legal previa a la firma del presente contrato.

El usuario reconoce expresamente que el prestador ostenta todo derecho, título e interés sobre la plataforma y los desarrollos informáticos asociados al servicio, así como sobre todos sus módulos, modificaciones y actualizaciones y sobre cualquier elemento y/o funcionalidad que fuera desarrollada sobre la misma, con independencia de si éste ha sido solicitado por el usuario o no. A estos efectos, se incluye sin limitación alguna, el reconocimiento de la titularidad del prestador de todos los derechos de autor, propiedad intelectual, y/o industrial, pudiendo explotar la plataforma, sin restricción alguna de naturaleza temporal, territorial, relativa a medios de difusión o modalidades de explotación y sin más limitaciones que las establecidas en las leyes.

La estructura, características, códigos, métodos de trabajo, sistemas de información e intercambio de la misma, herramientas de desarrollo, know-how, metodologías, procesos, tecnologías o algoritmos que constituyan y/o puedan constituir la plataforma, son propiedad exclusiva del prestador, encontrándose debidamente protegidos por las leyes nacionales e internacionales de propiedad intelectual y/o industrial, no pudiendo ser objeto de ulterior modificación, copia, alteración, reproducción, adaptación o traducción por parte del usuario, sin que exista el previo consentimiento expreso por parte del prestador.

Del mismo modo, todos los manuales de uso, textos, dibujos gráficos, bases de datos, que complementan la plataforma y/o los materiales asociados a ésta, son propiedad del prestador, sin que pueda ser objeto de ulterior modificación, copia, alteración, reproducción, adaptación o traducción por parte del usuario.

La puesta a disposición en modo servicio de la plataforma o el mero acceso por parte del usuario no implica, en ningún caso, la cesión de su titularidad, ni la concesión de un derecho de uso a favor del usuario distinto del expresado en estas condiciones.

Con el fin de que el usuario pueda utilizar la plataforma, propiedad exclusiva del prestador, ésta cede en virtud del presente contrato una licencia de uso a favor del usuario de carácter no exclusivo, de ámbito temporal limitado a cada periodo de conexión, de ámbito espacial ilimitado en la medida en que puede accederse desde cualquier equipo con Internet, intransferible, revocable y no sublicenciable.

En cualquier caso, queda absolutamente prohibida cualquier tipo de reproducción, imitación, transmisión, traducción, modificación, elaboración de obra derivada y/o comunicación pública, con independencia del medio empleado para ello, asumiendo en caso contrario el usuario infractor todas las responsabilidades directas o derivadas que pudieran llegar a producirse.

Para cualquier aspecto que no se encuentre expresamente reconocido en el presente contrato, se entenderá reservados todos los derechos a favor del prestador siendo necesaria la autorización escrita por parte de éste para poder llevarlo a cabo.

2. RELATIVOS A LOS CONTENIDOS E INFORMACIÓN DE LOS USUARIOS

Todos los contenidos e informaciones publicadas o gestionados por parte de los usuarios en la plataforma son propiedad exclusiva de éste, siendo https://www.marbellabanussuites.com/ un mero prestador de servicios de la sociedad de la información encargado del almacenamiento de datos.

El prestador no recibe ningún tipo de derecho de propiedad intelectual por el hecho de que el usuario los aloje o gestione en su plataforma, por lo que en ningún caso podrá tratarlos para fines diferentes a los directamente relacionados con la prestación de los servicios efectivamente contratados.

CONFIDENCIALIDAD Y PROTECCIÓN DE DATOS

De conformidad con lo dispuesto por el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos, todos los datos de carácter personal facilitados ddurante la prestación de los servicios serán tratados de conformidad con lo dispuesto en la Política de Privacidad, que todo usuario debe aceptar expresamente y de forma previa para poder registrarse.

Todo usuario que acepte las presentes condiciones de uso, aceptan de forma informada, expresa e inequívoca nuestra Política de Privacidad, asistiéndole en este sentido los derechos de acceso, rectificación, cancelación y oposición respecto a sus datos de carácter personal, pudiendo ejercerlos según se informa en la mencionada Política de Privacidad.

CONDICIONES ECONÓMICAS

Las tarifas aplicables a cada uno de los servicios ofrecidos a través de la plataforma serán única y exclusivamente aquellas que se encuentren publicadas en la plataforma online, siendo éstas las únicamente válidas, salvo error tipográfico o de transcripción, caso en el que el prestador se compromete a modificarlas inmediatamente.

El prestador se reserva el derecho a anular las contrataciones realizadas   desde el momento de su realización en caso de que detecte la existencia de errores tipográficos o de transcripción en el precio y/o los impuestos aplicados a la transacción.

El prestador se reserva el derecho a realizar cualquier tipo de modificación sobre las tarifas de cada alojamiento, comprometiéndose éste a publicarlas en la plataforma de forma visible para los usuarios. Salvo disposición en contrario, la modificación de tarifas no tendrá carácter retroactivo.

Las cantidades económicas únicamente podrán ser abonadas mediante domiciliación bancaria o mediante tarjeta de crédito, no contando en ningún momento el prestador con acceso a ningún dato bancario o de las tarjetas de crédito.

Todas las tarifas se verán incrementadas con el importe correspondiente a los impuestos vigentes en la fecha de emisión de la factura, quedando debidamente reflejados en el resumen de cada compra.

EXTINCIÓN DEL CONTRATO

El presente contrato puede ser extinguido siempre que se produzca alguna de las siguientes circunstancias:

• Incumplimiento de las obligaciones dispuestas en el presente contrato.
• Por el transcurso de su plazo de duración
• En caso de que no se abonen conforme a los plazos y forma acordados las cantidades económicas correspondientes. La reserva  será automáticamente bloqueado el día siguiente al momento en que se produzca el impago. Para su reactivación únicamente será necesario realizar el abono de la cantidad económica que corresponda.
• La disolución, liquidación o pérdida de personalidad jurídica .
• Cualquier cambio o variación sustancial de las condiciones esenciales que fueron indicadas en el presente contrato para llevar a cabo la celebración del presente contrato.

LEY APLICABLE Y JURISDICCIÓN

Para cualquier controversia o conflicto que pudiera surgir, derivado de estos términos o condiciones, resultará de aplicación la Ley Española. La resolución de los conflictos judiciales se someterá a la competencia de los Juzgados y Tribunales del domicilio del usuario o cliente.
